Terms and Provisions of Agreement 1. The Springbrook OA picnic Pavilion is available for reservation by Springbrook Owners Association residents between the hours of 9:00 AM and 8pm. 2. Reservations must be made at least 1 week in advance. Reservations will not be accepted more than three months in advance. Reservations will not be accepted from residents who are not current with their Homeowner Association dues. 3. All Springbrook OA residents signing this agreement as hosts of a private party must be present at the event at all times including setup and cleanup. 4. Reservations only include the pavilion, adjacent grills, picnic tables, playground and surrounding area that belong to the Springbrook OA HOA. 5. After each use of the pavilion, residents are required to leave the space in the same condition as before the event. This includes but is not limited to disposing of garbage and cleaning tables and grills. 6. The host is responsible for alcohol consumption of all guests and for compliance with alcoholic beverage laws and regulations. The host expressly assumes any and all social host liability which may arise out of or relate to the use or occupancy of the pavilion. 7. The host is responsible for the conduct of all guests. The host expressly assumes liability for any and all damage to the pavilion, its fixtures and furniture, or to the related common areas, which arises out of or relates to the use or occupancy of the pavilion. 8. The Host expressly agrees and covenants to release, indemnify and hold harmless Springbrook OA HOA, Inc. and Innovative Admin Svcs and their respective officers, directors, agents, employees, independent contractors and volunteers (the “Released Parties”) from any and all harm, damages, claims, fines, suits, demands, actions, or other liability, including without limitation personal injury, death, or property loss of any person, and including costs and expenses of any kind or nature whatsoever including without limitation attorneys fees, which arises out of, relates to or results from the use or occupancy of the pavilion and related common areas. 9. Reservation fee for Springbrook Park Pavilion is $100. $75 of this fee is refundable to Host upon inspection of the facility after event for which pavilion is reserved, upon confirmation that the area has been cleaned sufficiently, and trash bags have been removed from the park. Release of Liability In Consideration of being allowed to utilize the Springbrook Owner’s Associations (SOA) pavilion facility, the undersigned, on his or her behalf, and on the behalf all other participant(s), acknowledges, appreciates, and agrees to the following conditions: I agree that the participant(s) and I shall comply with all stated and customary terms, State and Federal laws, City ordinances, posted safety signs, rules, and verbal instructions as conditions for utilizing the Pavilion. In addition, if I observe any hazardous activity during our participation, I will bring it to the attention of the SOA or an appropriate official immediately. I am aware that there are inherent risks associated with the use of the pavilion, parties, and/or use of the area and I, on behalf of myself and the participant(s) named below, knowingly and freely assume all such risk, both known and unknown, including those that may arise out of the negligence of other participants and, I, for myself and the participant(s) named below, and our respective heirs, assigns, administrators, personal representatives, and the next of kin, hereby release and hold harmless, Springbrook Owner’s Association their affiliates, officers, members, agents, employees, and sponsoring agencies from and against any and all claims, injuries, liabilities or damages arising out of or related to our use of the pavilion. Additionally, I understand that the use of the pavilion is restricted to SOA owners and their guests. As the SOA owner sponsoring this event, I will be present at the pavilion for the duration of the event.
